Bid and Proposal Submittal

 

Bid Submittal

When valued at more than $10,000, a sealed bidding process is generally conducted for the following procurements:

  • Materials, supplies and equipment
  • Maintenance and non-professional services
  • Construction
  1. Notice Inviting Bids (NIB) specify the time and place of bid opening. The NIB includes the applicable project information and bid submittal requirements.
  2. A bid is late if it is received at the location designated in the NIB after the date and time set for bid opening. A late bid will be rejected and will remain the property of the bidder.
  3. Once the deadline for submission of bids has passed, the initial bid results are posted.

Proposal Submittal

The Water Authority solicits professional and technical services through a Request for Proposals (RFP) and/or Request for Qualifications (RFQ).

  1. The Water Authority uses competitive proposals primarily for professional and technical services.
  2. Proposals are solicited through an RFP.
  3. A pre-proposal meeting may be conducted before submission of proposals to explain the scope of work and proposal requirements. Attendance at a pre-proposal meeting may be designated as mandatory for the submission of a proposal.
  4. The RFP states the relative importance of price and other evaluation factors.
  5. The contract, if awarded, is to the responsible and responsive offeror whose proposal is determined to be the most advantageous to the Water Authority in accordance with the RFP’s procedures for evaluation of proposals. The Water Authority may reject all proposals if it is in the public interest.
  6. After a proposer is selected, the award of a contract is contingent upon the successful negotiation of terms and fees, and approval by the Water Authority. 

Senate Bill 854

The Water Authority reminds all contractors and subcontractors of the adoption of Senate Bill 854 and encourages all contractors and subcontractors to ensure that they are familiar with and comply with the requirements enacted in June 2014. Such requirements include, but are not limited to, the requirement that contractors and subcontractors register with the Department of Industrial Relations, State of California (DIR), pursuant to Labor Code section 1725.5, which began July 1, 2014.

Beginning on March 1, 2015, in compliance with SB 854, the Water Authority will require all contractors and subcontractors to be registered with the DIR prior to submitting a bid on any public works project. Bids from contractors or subcontractors that are not registered as required will be deemed nonresponsive. Further, beginning on April 1, 2015, the Water Authority will not award a contract to and no contractor or subcontractor will be allowed to work on a Water Authority project unless contractor and each subcontractor are registered with the DIR pursuant to Labor Code section 1725.5. Please consult with your respective counsel for further information.

Additionally, contractors and subcontractors will be required to electronically upload certified payroll records (eCPRs) to the Labor Commissioner for all new public works projects awarded on or after April 1, 2015. This requirement will apply to all new or ongoing public works projects on or after January 1, 2016.
